Certificate of Compliance (CoC)

All projects that receive an Order of Conditions from the Conservation Commission will need to obtain a Certificate of Compliance (WPA Form 8B) once all work and restoration described within the Order of Conditions has been completed. Note that erosion and sedimentation controls should not be removed until the Request for Certificate of Compliance has been approved by the Conservation Commission. Applicants should refer to the Wetlands Regulations 310 CMR 10.05(9) “Certificates of Compliance” when they are preparing to file a Notice of Intent and when filing a Request for Certificate of Compliance.

Required documents for the Request for Certificate of Compliance include:

WPA Form 8A 

Filing fee check of $50.00 made out to the Town of Franklin

Filing Fee Calculation Worksheet

Final As-Built Plan of the property for where an Order of Conditions was filed for work on, and

Letter from the Engineer of the project.

Once the Request for Certificate of Compliance is submitted to the Conservation Department, the Conservation Agent will review the application to ensure that the site is in compliance with any and all conditions imposed in the Order of Conditions.  Requests for Certificates of Compliance are not public hearings.  Within 21 days of filing, the Conservation Commission will begin discussion of granting a Certificate of Compliance under General Business.  If a majority of the Commission approves and signs the Certificate of Compliance, the signed copy will need to be brought to the Registry of Deeds and proof returned to the Franklin Conservation Department.
